These terms are written as a general service framework. They do not replace a negotiated subscription agreement or legal advice specific to your circumstances.
1. Agreement and eligibility
These Terms of Service govern access to Masskani Property Management System (‘Masskani’, ‘we’, ‘us’ or ‘our’) and its website and software features. By accessing or using the service, you agree to these terms. If you use Masskani for a company or property owner, you confirm that you are authorised to bind that organisation. If you do not agree, do not use the service.
2. The service
Masskani provides digital tools that may help landlords and property managers organise properties, units, tenants, leases, billing, invoices, payment records, expenses, utilities, maintenance, reports, staff access and related records. Features may vary by account, subscription, workspace settings and availability. The platform supports your property-management work; it does not itself become the landlord, tenant, agent, bank, payment provider or legal adviser.
3. Accounts and security
You must provide accurate account information, keep credentials confidential, and promptly notify the appropriate administrator if you suspect unauthorised access. You are responsible for activity carried out through your account, except to the extent applicable law provides otherwise. Do not share accounts where individual access is available. Workspace owners must assign appropriate roles, review permissions, and remove access when it is no longer required.
4. Workspace data and authority
You retain responsibility for the information you and your authorised users enter, upload or generate, including property details, tenant records, lease documents, payment evidence, utility readings and maintenance attachments. You must have the legal authority and necessary permissions to use that information in the service. Keep records accurate and lawful, and do not upload content that infringes another person's rights or exposes information unnecessarily.
5. Subscription, fees and capacity
Access to paid features may depend on an active subscription and the plan or capacity selected for your workspace. Applicable prices, covered properties or units, payment instructions, renewal arrangements and any taxes should be reviewed in the platform before payment. A submitted payment reference or proof may require verification and does not, by itself, guarantee that a subscription has been activated. Contact support if a payment or capacity status appears incorrect.
6. Invoices, payments and records
Masskani may help generate invoices, receipts, statements and reports based on information and settings supplied by users. You are responsible for checking amounts, dates, tax settings, payment instructions and generated documents before relying on them. Unless a workflow explicitly confirms otherwise, displaying or uploading payment information is not the same as funds clearing or being independently verified. Reconciliation and tenant balances should be reviewed by an authorised person.
7. Acceptable use
You must not misuse the service, attempt to access another workspace without permission, bypass authentication or role controls, probe or disrupt infrastructure, introduce malicious code, use the platform for fraud or unlawful discrimination, upload unlawful or harmful material, or use the service to send unsolicited communications in violation of applicable law. You must not reverse engineer or resell access except where permitted by law or a separate written agreement.
8. Privacy and third-party services
Our handling of information is described in the Privacy Policy. The service may rely on third-party infrastructure and service providers for hosting, authentication, communications and other features. Third-party products may be subject to their own terms, availability and privacy notices. You are responsible for reviewing relevant third-party terms when you use those services.
9. Availability, changes and support
We aim to provide a dependable service but do not promise uninterrupted or error-free operation. Maintenance, connectivity issues, third-party outages, security events or circumstances beyond our reasonable control may affect availability. Features may be updated, replaced or discontinued as the platform evolves. We will use reasonable efforts to address reported issues, but response times and support scope may depend on the service arrangement.
10. Intellectual property
Masskani and its licensors retain rights in the platform, software, branding, design and related materials, except for rights belonging to users or third parties. Subject to these terms and your applicable subscription, we grant you a limited, non-exclusive, non-transferable right to use the service for your internal property-management activities. You may not remove proprietary notices or imply endorsement by Masskani without permission.
11. Suspension and termination
Access may be restricted or suspended where reasonably necessary to protect the service or users, investigate suspected misuse, comply with law, address a security risk, or respond to material breach of these terms. Where appropriate, we will provide notice and an opportunity to resolve the issue. When use ends, you remain responsible for obligations already incurred. Any access to or export of records after termination may depend on the account arrangement and applicable law.
12. Disclaimers and responsibility
To the extent permitted by law, the service is provided on an ‘as available’ basis. Masskani does not guarantee that platform outputs will be complete or suitable for every legal, tax, accounting, tenancy or business decision. Users must verify important records and obtain professional advice where needed. Nothing in these terms excludes a right or liability that cannot lawfully be excluded.
13. Limitation of liability
To the extent permitted by applicable law, Masskani will not be liable for indirect or consequential loss, lost profits, lost opportunities, or losses arising from inaccurate user-entered data, unauthorised sharing of credentials, third-party outages, or decisions made solely on unverified platform outputs. Any liability that cannot be limited under applicable law remains unaffected. This section should be read consistently with any separate written agreement that applies to your subscription.
14. Changes to these terms
We may revise these terms to reflect changes to the service, business or applicable law. The updated version will be posted on this page with a revised date. Where required, material changes will be communicated or consent will be requested. Continued use after changes take effect constitutes acceptance to the extent permitted by law.
15. Governing law and contact
These terms are intended to be interpreted consistently with the laws of Kenya, subject to any mandatory consumer or other protections that apply to you. Disputes should first be raised with us in good faith so the parties can seek a practical resolution. Contact info@masskani.co.ke or write to Masskani Property Management System, Nairobi, Kenya.
